政法机关服务法治化营商环境的路径优化研究

Study on the Optimization of the Path of Government and Legal Organs to Serve the Legalization Business Environment

社会治理现代化内在要求社会治理法治化,而发展市场经济内在要求营商环境法治化。政法机关服务法治化营商环境的实践面向服务对象、服务方式和服务目标三个维度,要求作为服务主体的政法机关保障市场主体的平等参与,运用法治思维和法治方式优化营商环境,促进营商环境的和谐有序与充满活力的平衡发展。政法机关服务法治化营商环境应秉承“党领共治模式”进行实践创新,拟从以下路径契入:服务营商的法制环境,坚持党委领导、人大主导和政府依托立法的统一;服务营商的执法环境,保证执法为民与严格规范公正文明执法的统一;服务营商的司法环境,奉行司法为民与司法权威的统一;服务营商的守法环境,力求带头守法与全民守法的统一;服务营商的法治监督环境,形成纪法界分与纪法协同的统一。

The modernisation of social governance inherently requires the legalization in social governance,while the development of a market economy inherently requires the legalization of the business environment.The practice of government and legal organs in serving the legalization of the business environment is oriented towards the three dimensions of service targets,service methods and service goals,requiring government and legal organs as service subjects to guarantee the equal participation of market subjects,optimize the business environment using rule of law thinking and rule of law methods,and promote a harmonious,orderly and dynamic balance in the business environment.The government and legal organs should adhere to the"party-led governance model"in serving the legalization of the business environment and carry out practical innovation.The following paths are proposed:to serve the legal environment for business,insisting on the unity of the leadership of the party committee,the leadership of the National People's Congress and the government relying on legislation;to serve the law enforcement environment for business,ensuring the unity of law enforcement for the people and strict,standardized,fair and civilized law enforcement;to serve the judicial environment for business,pursuing the unity of justice for the people and judicial authority;to serve the law-abiding environment for business,striving to take the lead in law-abiding and the unity of law-abiding for all people;to serve the legalization of the supervision environment for business,forming the unity of disciplinary boundaries and discipline and law synergy.
