论监察体制改革背景下留置措施的完善

On Perfecting the Detention Measures in the Context of Supervision System

《监察法》的颁布改变了原先“双指”“双规”处于法律规则外围的状况,用留置措施取而代之更有利于依法惩治腐败,建立集中统一、权威高校的反腐败体制。鉴于《监察法》颁布时间尚短,对留置措施仅作原则性规定,实践中存在执行程序不完善、与司法程序衔接不顺畅、执行缺乏有效的监督机制等问题,被留置对象权益无法得到有效保障。应明确留置措施的适用条件和执行场所,规范羁押替代性措施的设置,完善监察机关退回补充调查的衔接程序,加强留置措施的内部及外部监督,保障被留置对象的合法权益,完善留置措施的适用。

The promulgation of the"Supervision Law"has changed the situation where the original"Two Designations"and"Two Regulations"are located outside the legal rules.Replacing them with lien measures is more conducive to punishing corruption according to law and establishing a centralized,unified,and authoritative anti-corruption system for universities.However,based on the short time of promulgation of the"Supervision Law",only principle provisions are made for lien measures,and in practice,there are some problems due to imperfect implementation procedures and unsmooth connection with judicial procedures.Due to the lack of an effective monitoring mechanism for the implementation,the rights and interests of the detained object cannot be effectively protected.Therefore,it is necessary to clarify the applicable conditions and place of enforcement of the detention measures,standardize the setting of alternative measures for custody,improve the connecting procedures for the return of supplementary investigations by supervisory authorities,strengthen internal and external supervision of the detention measures,protect the egitimate rights and interests of the detained object,and improve the application of the amount of the detention measures.
