数据知识产权是数据基础制度的重要组成部分,创设独立的数据知识产权专门法律,目前并不是一种可实施的制度方案选择,而思考将数据融入现有知识产权客体之中,调整和丰富现有知识产权与竞争法制度,赋予适当的使用数据的例外与限制性规则,促进物联网、人工智能等数字前沿技术的发展,夯实和增强我国在新一轮科技革命和产业变革中的相对优势地位,才是当前应该选择的数据知识产权中国方案。但要审慎对待的是,在这一轮的新科技革命与产业变革中,相比于其他科技大国,我国是一个数据资源与应用场景丰富的大国。如何在新的科技竞争中依托并发挥这种数据资源与应用场景优势,防止“数据殖民主义”,积极参与乃至引领新科技革命与产业变革的可持续性发展,是数据知识产权中国方案从政治、经济与法律等多维视角进行校准的一个基点。

Data intellectual property rights are an important part of the data basic regulation,and creating an independent special law on data intellectual property rights is not an implementable option as an institutional solution at present.Instead,it is imperative that the Chinese solution for data intellectual property rights should be chosen by considering the integration of data into existing objects of intellectual property rights,adjusting and enriching the existing intellectual property and competition law systems,granting appropriate exceptions and restrictions on the use of data,promoting the development of digital technologies such as the Internet of Things and artificial intelligence,and consolidating and enhancing China's comparative advantage in the new round of technological revolution and industrial change.However,it is prudent to note that in this round of new technological revolution and industrial change,China is a large country with abundant data resources and application scenarios compared to other major scientific and technological powers.Therefore,how to leverage the advantages of such data resources and application scenarios in the new technological competition,prevent"data colonialism",and actively participate in and even lead the sustainable development of the new technological revolution and industrial transformation is the base point from which the Chinese solution for data intellectual property rights program must be calibrated from a political,economic and legal perspective.
