摘要
2021年实施的新《中华人民共和国档案法》对档案开放利用提出了更高的要求,大力开展档案开放审核成为当前档案工作的紧迫需求。为加快推进档案开放审核工作,亟须建立免责机制。本文从免责的实体性规定、程序性规定、配套措施三个层面入手,剖析我国综合档案馆档案开放审核免责机制构建的现实困境,并适当借鉴立法、司法、行政领域的成功经验,提出细化免责的实体性规定、序化免责的程序性规定、健全免责的配套措施三个方面的针对性实施路径。
The new Archives Law of the people's Republic of China implemented in 2021 puts forward higher requirements for the opening and utilization of archives,and vigorously carrying out archives open audit has become an urgent demand for the current archives work.In order to speed up the work of archives open audit,it is urgent to establish the exemption mechanism.Starting from the substantive provisions,procedural provisions and supporting measures of exemption,this paper analyzes the practical difficulties in the construction of the exemption mechanism for the archives open audit in China's comprehensive archives.In addition,this paper properly draws on the successful experience in the legislation,judicature and administration fields,and puts forward three specific implementation paths:detailed substantive provisions of exemption,orderly procedural provisions of exemption,and perfect supporting measures of exemption.
