建构中国法学自主知识体系的原则与方法

The Principles and Methods of Constructing the Independent Knowledge System of Chinese Law

在坚持全面依法治国、推进法治中国建设的新征程中,建构中国法学自主知识体系具有重大的理论和实践意义。在建构原则上,建构中国法学自主知识体系,要坚持以习近平法治思想为引领,坚持以人民为中心的价值立场,坚持继承性和民族性、原创性和时代性、系统性和专业性的有机统一,坚持挖掘历史、把握当代、面向未来的科学思路。在建构方法上,建构中国法学自主知识体系,要融通古今中外各种资源,吸收我国优秀法治文明成果,借鉴国外有益法治经验,要将法理学与部门法相结合,将法学与其他学科相融合。此外,还要以构建中国特色法学学科体系、学术体系、话语体系作为关键抓手,以自主性、原创性和创新性作为重要着力点,以法治实践作为知识体系建构和发展的主要来源。

In the new journey of adhering to the comprehensive rule of law and promoting the construction of rule of law in China,it is of great theoretical and practical significance to construct the independent knowledge system of Chinese law.In terms of the construction principle,to construct the rule of law in China,we should adhere to the people-centered value position,the organic unity of inheritance and nationality,originality and epochal nature,systematism and specialization,and the excavation of history,grasping the contemporary,futureoriented scientific thinking.In terms of the construction method,in order to construct the independent knowledge system of Chinese law,we should integrate the ancient and modern resources,absorb the excellent achievements of Chinese legal civilization,and draw lessons from the beneficial experience of foreign legal system.We should combine jurisprudence with positive law and integrate jurisprudence with other disciplines.In addition,we should also construct the discipline system,academic system and discourse system of law with Chinese characteristics as an important channel;regard autonomy,originality and innovation as the important focus;regard the practice of rule of law as the main source for the construction and development of knowledge system.
