浅谈公知常识的充分说理

Analysis of the efficient reasoning of common knowledge

《专利审查指南(2010)》中对公知常识的说理方式尚存在进一步明确的空间,审查员如何在审查程序中争取主动,使评述理由令申请人更加信服,成为发明专利审查中的难题。提出从三个方面着手解决此难题,第一是明确公知常识充分说理的相关概念,第二是公知常识说理存在的问题,第三是公知常识充分说理的操作建议。

Because there are no definite standard of the reasoning of common knowledge in Chinese Patent Examination Guidelines(2010),which make it a difficult issue to convince applicant in auditing program.This article solves the above issue through three aspect.First of all,make clear the concepts of the reasoning of common knowledge.Secondly,analysis the problem of the reasoning of common knowledge.And finally,give some suggestions on the reasoning of common knowledge.
