在专利审查中,确定实际解决的技术问题采用“区别特征-技术效果-技术问题”的判断思路,而技术效果是确定发明实际解决技术问题的客观依据。为了准确认定实际解决的技术问题,首先,通过一个典型的诉讼案例比较了专利审查和两级法院在行政和司法中的认定异同,突出了确定实际解决技术问题在创造性判断中的重要性。其次,结合专利审查实践经验,提出了在确定实际解决技术问题时应从技术效果和保护范围的视角综合考虑,并归纳了应当注意的几点考量。

In the patent examination,the actual technical problem solved by the invention is determined following the rule of“distinguishing features-the technical effect-the technical problem”,and the technical effect is the objective basis for determining the actual technical problem.In order to accurately determine the actual technical problem,firstly,this paper compares the differences and similarities between the patent examination and the two courts in the administrative and judicial trials through a typical litigation case,and highlights the importance of determining the technical problem actually solved in assessing the inventive step.Secondly,based on practical experience in the patent examination,this paper considers the formulation of the technical problem from the perspective of the technical effect and the scope of protection,and summarizes several considerations.
