论个人破产与参与分配的衔接——基于深圳地区1371件个人破产案件的实证分析

On the Connection between Individual Bankruptcy and Participation in Distribution--Empirical Analysis Based on 1371 Individual Bankruptcy Cases in Shenzhen

个人破产是为保证自然人在符合条件时退出市场竞争诞生的,而在其应用之前就已经存在参与分配程序发挥着替代破产的功能,为促进二者的相互衔接,汇总近两年深圳破产法庭受理的个人破产案件,总结个人破产案件在实际运行过程中的特点;将个人破产和参与分配的法律条文对比,探究二者在理论上的各自优势。在此背景下构建“一般执行—参与分配—个人破产”的衔接逻辑,并对其中的流程节点、总体思路、衔接细节和冲突规则进行推演,以期对司法实践有所裨益。

Individual bankruptcy is to ensure that natural persons can withdraw from the market competition when they meet the conditions,which has played a role in replacing the fiinction of bankruptcy in the procedure of participation in distribution before its application.Individual bankruptcy cases accepted by Shenzhen Bankruptcy Court are collected to summarize the characteristics of individual bankruptcy cases in the actual operation process.Their advantages are studied through the legal provisions of individual bankruptcy and participation in distribution.The cohesive logic of"general execution-participation in distribution-individual bankruptcy"is constructed,and the process nodes,general ideas,cohesive details and conflict rules are deduced to provide reference for judicial practice.
