The Impacts of EU International Procurement Instrument on China and Chinese Countermeasures

2022年8月29日,欧盟《国际采购工具》法案(IPI)正式生效,旨在对来自缺乏互惠的第三国经营者、货物和服务进入欧盟公共采购市场进行限制,该法案生效后,将对非欧盟成员国包括中国产生一系列不利影响,中国企业进入欧盟市场将面临更多阻碍,中国政府与欧盟进行双边谈判,加入WTO《政府采购协定》的谈判难度也会加大。对此,我国应采取有效措施积极应对:一方面要充分利用IPI对我国企业造成实质性影响前的窗口期,加快修订《中华人民共和国政府采购法》等国际贸易规则,不断完善国内政府采购体系,争取利益最大化;另一方面要全面推进高水平对外开放,循序渐进开放我国公共采购市场,开辟更广阔的国际公共采购市场,以不断推进我国国际经济贸易高质量发展。

On August 29,2022,the EU International Procurement Instrument(IPI)came into force,which aims to restrict the access of economic operators,goods and services from third countries that lacking reciprocity to the EU public procurement market.After the regulation comes into force,it has a series of adverse effects on non-EU member states,including China,and Chinese companies will face more obstacles to enter the EU market.It will also be more difficult for the Chinese government to conduct bilateral negotiations with the EU as well as negotiations on China’s accession to the WTO Agreement on Government Procurement.In this regard,China should take effective measures to actively respond:on the one hand,we should make full use of the window period before the real launch of IPI,accelerate the revision of the Government Procurement Law of the People’s Republic of China and other international trade rules,and strive to maximize the benefits;on the other hand,we should comprehensively promote high-standard opening up,not only to gradually open up China’s public procurement market,but also to make efforts to open up a broader international public procurement market,in order to continuously promote the high-quality development of China’s international economic and trade.
