警犬伤人后的行政救济制度分析与研究

如今警犬伤人风险在不断提升。而现行的关于警犬伤人后的救济制度,存在操作性不强,概念及范围规定模糊的问题。当下警犬伤人基本上可分为警犬误伤、警犬主动伤人、警犬无过错下的伤人、特殊携犬主体履职情形下的警犬伤人四种情形。针对警犬误伤和主动伤人宜起动补偿程序;而对于警犬无过错伤人以及特殊主体所带警犬伤人则需根据带犬主体的行为进行具体分析且警犬伤人后的救济制度可参照国家赔偿救济程序,由公安机关法治部门承担救济程序的启动、监督工作。同时,对于警犬使用主体则应采取岗位资格审查和个人作业能力同步考察的机制,还可采取公安机关与商业保险公司合作的方式,作为一种具有过渡性质的公安行政补偿救济手段。

The risk of dogs injuring people continues to increase.However,the current relief system for police dogs injuring people has some problems,such as a lack of operability and unclear terms and scope.Through research,police dog hurting is analyzed in four situations.It is appropriate to initiate National Reimbursement procedures for incidents of accidental and active injury by police dogs,and it is necessary to make a specific analysis on the behavior of the subject with the dog for the police dog injuring people without fault and the police dog injuring people by special subject.In addition,the relief system after police dogs injuring people can refer to the national compensation relief procedure,and the legal department of the public security organ is responsible for the initiation and supervision of the relief procedure.For the main users of police dogs,we should adopt the system of post-qualification examination and simultaneous inspection of individual operational ability.Finally,cooperation with public security agencies and commercial insurance companies can be used as an interim means of reimbursement and relief for public security.
