在“双碳”政策背景下,碳排放成为法律权利具有正当性。但鉴于财产权取得以及权利客体可交易性等方面与现有权利理论不能兼容,所以单一将碳排放权私权化或者公权化的解释路径都不合适,兼具公私属性的环境权是更好的选择。生态环境部门作出的碳排放配额设计是转承碳排放行政许可和配额市场交易的关键,碳交易市场中流通的是配额而非权利,这一模式对未来发展碳金融以及推动全国碳交易市场接入国际轨道有重要意义。

The policy system under the“double carbon”goal and the actual demand for greenhouse gas emission reduction make carbon emission behavior become a right.However,given that the acquisition of property rights and the tradability of the right object are not well compatible with the existing rights theory,the interpretation path of the privatization of carbon emission rights is not appropriate.Environmental rights with both public and private attributes are better choices.The carbon emission quota design made by the ecological environment department is the key to carry forward the carbon emission administrative license and quota market trading.The circulation in the carbon trading market is quota rather than rights.This model is of great significance to the future development of carbon finance and the promotion of the national carbon trading market to access the international track.
