习近平法治思想是我国立法、司法的指导思想,理应在裁判文书释法说理中得以体现。写作裁判文书应当准确运用习近平法治思想,结合文义解释、体系解释、目的解释、历史解释、社会学解释等科学的法律解释方法,通过建立识别指引机制、培训提升机制、考评激励机制、监督管理机制、宣传推广机制,确保习近平法治思想准确融入裁判文书释法说理,使人民群众在每一个司法案件中感受到公平正义。

Xi Jinping’s thought of rule of law is the guiding ideology of legislation and judicature in China,which should be embodied in the interpretation and reasoning of judicial documents.In writing adjudicative documents,Xi Jinping’s thought of rule of law should be accurately applied,combined with scientific legal interpretation methods such as literal interpretation,system interpretation,purpose interpretation,historical interpretation and sociological interpretation,and through the establishment of identification and guidance mechanism,training and promotion mechanism,evaluation and incentive mechanism,supervision and management mechanism and propaganda and promotion mechanism,making the people feel fairness and justice in every judicial case.
