刑事诉讼中醉酒型危险驾驶罪的证据认定研究

Research on the Determination of Evidence for Drunken Driving Offences in Criminal Proceedings

醉驾入刑对打击醉酒驾驶行为、维护公共安全起到了重要作用,但在刑事诉讼中,醉酒型危险驾驶罪的证据认定尚有困境,例如对于酒精测试结果效力存疑的问题、行为人特殊情况的应对难点以及孤证不立的情况。基于此,提出规范调查取证程序、强化人员组织工作及加强证据印证和补强等相应解决方案,促进醉酒型危险驾驶罪证据认定的合规性和有效性。

The criminalization of drunken driving offenses has played an important role in combating drunken driving and maintaining public safety,but there are still dilemmas in the determination of evidence for drunken driving offenses in criminal proceedings,such as the problem of doubtful validity of alcohol test results,the difficulty of responding to the special circumstances of the perpetrator,and the failure to establish lone evidence.Based on this,the corresponding solutions such as standardizing the investigation and evidence collection procedures,strengthening the organization of personnel and enhancing the corroboration and reinforcement of evidence are proposed in the research to promote the compliance and validity of the evidence of drunken driving offenses.
