基于水电开发视角云南环境影响评价制度的立法思考

Legislative Consideration of Environmental Impact Assessment System in Yunnan from the Perspective of Hydropower Development

基于水电开发的视角,采用文献研究方法,对云南环境影响评价制度进行研究,对立法现状与困境进行了梳理和分析,找出其中问题,以此对现行云南环境影响评价制度的立法提出建议。结果表明:现有立法与云南水电发展实际不匹配,未将绿色低碳循环原则融入相关规定,环境影响后评价制度规定与国家层面的处理意见存在偏差,环境公众参与规定未能充分贯彻上位法精神且内容规定尚不完善。据此提出将现有规范性文件整合,并上升为地方性法规,完善环境影响评价制度和夯实环境公众参等建议。

This article aims to study the environmental impact assessment system in Yunnan from the perspective of hydropower development,identify problems and make suggestions for improvement.The article mainly uses literature research methods.It first elaborates on the problems and literature review,and then sorts out and analyzes the legislative status quo and difficulties.The study finds that the existing legislation is not compatible with the actual development of hydropower in Yunnan,and the green low-carbon cycle principles are not integrated into relevant regulations.There is a deviation between the environmental impact post-evaluation system and the handling opinions at the national level.The environmental public participation regulations have not fully implemented the spirit of higher-level laws,and the content provisions are not yet perfect.Suggestions include integrating existing normative documents into local regulations,improving the environmental impact post-evaluation system,and strengthening the environmental public participation system.
