律师辩护全覆盖视域下二元化刑事法律援助制度的发展

The Development of a Dualized Criminal Legal Aid System from the Perspective of Full Coverage of Lawyers Defense

在律师辩护全覆盖的推动下,我国初步形成以法律帮助和援助辩护为基础的二元化的刑事法律援助格局。正确认识值班律师功能定位,理性看待值班律师同法律援助辩护律师对律师辩护全覆盖实现的功能。在此基础上,一方面适当扩大传统刑事法律援助辩护的范围,另一方面推动实现值班律师法律帮助实质化,使值班律师同法律援助辩护律师相互衔接,共同完成律师辩护全覆盖的目标。

Under the impetus of full coverage of lawyers defense,China has initially formed a dualized criminal legal aid pattern based on legal assistance and defense assistance.We should correctly understand the functional positioning of duty lawyers,and rationally view the functions realized by duty lawyers and legal aid defense lawyers in providing full coverage of lawyers defense.On the one hand,appropriately expand the scope of traditional criminal legal aid defense,and on the other hand,promote the realization of the substantive legal assistance of duty lawyers,so that duty lawyers and legal aid defense lawyers can connect with each other and jointly complete the goal of full coverage of lawyers defense.
