论“服务器标准”下的作品传播问题

Research on the Dissemination of Works under the“Server Standard”

“服务器标准”是认定网络环境中的“信息网络传播行为”的标准之一,即只有将作品上传至向公众开放的服务器的行为,才是受信息网络传播权控制的“网络传播行为”,也才有可能构成对信息网络传播权的直接侵权。然而随着科技的发展,一些互联网技术被广泛用于规避“服务器标准”所要求的“上传”行为,僵化的“服务器标准”架空了权利人对作品传播的控制,满足不了当下对著作权完整保护的需求。基于此,本文认为,不能仅以“上传至服务器”为标准判断通过深层链接展示作品是否构成侵权,而应该以信息网络传播权规制的“传播行为”,解读设置深层链接的行为性质,采用“传播行为控制标准”全面保护著作权人的权利。

“Server standard”is one of the criteria for determining“information network dissemination”,that is,only when a work is uploaded to servers open to the public is it defined as network dissemination behavior,and it may infringe on the right to information dissemination.However,with the advancement of technology,some internet technologies have been widely used to circumvent“uploading”required by the“server standards”.The rigid“server standards”have hollowed out the right holder’right over the dissemination of works,which failed to meet the current demand for copyright protection.Based on this,it’s believed that the requirement of“uploading to the server”should not be the sole criteria for determining whether displaying works through deep links constitutes infringement,rather,the nature of deep links should be interpreted according to“dissemination behavior”,in order to effectively protect the rights of copyright owners.
