教育法典向何处去——基于《民法典》的编纂经验展开 被引量:2

Where is the Educational Code Going:Based on the Experience of Compiling the Civil Code

摘要 作为我国法典化的开端与范例,《民法典》为教育法典的编纂提供了可供参酌的宝贵经验。因此,通过认真审视“《民法典》如何而来”,有助于我们更好地思考“教育法典向何处去”。研究认为,在宏观理念层面,教育法典应当追求体系理性,采取体系化的编纂模式;坚持问题导向,积极回应教育领域的实践需求;奉行权利本位,把确认和保障受教育权作为法典的核心任务。在编纂路径层面,教育法典应与单行法形成“分步渐进+动态同步”的统筹发展关系,总则应以法律关系作为逻辑主线,分则宜将教育类型作为编排基准。 As the beginning and model of codification in China,the Civil Code provides valuable experience for reference in compiling educational code.A careful examination of"How the Civil Code came to be"will help us to think better about“where the Educational Code is going”.The study concludes that,in terms of macro concept,the educational code should pursue systematic rationality and adopt a systematic compiling mode;adhere to the problem orientation and actively respond to the practical needs in the field of education;be right-centered and take the confirmation and protection of the right to education as the core task of the code.In terms of compilation path,the educational code should form an overall development relationship of"step by step+dynamic synchronization"with the single law.The general part of the educational code should take the legal relationship as the logic thread,and its specific part should take the educational type as the layout benchmark.
