住区规划中多主体日照权益遮挡时间分配探析

摘要 建筑高密度片区内的住区规划设计时,因多地块相邻,规划报审时常存在以下日照遮挡问题:某两个不同业主的A、B地块、规划设计时对地块C的建筑进行日照分析,各单独计算时满足国家日照标准无遮挡,报审时发现共同计算时产生了遮挡,该情况下各主体权益遮挡时间应如何划分?如何避免该类问题的产生?文章采用了建立理论模型进行分析研究,提出将日照权益遮挡时间作为地块前期的日照设计条件的设想,使相邻地块在日照条件上可独立开展设计不必必须联合计算日照、联合规划设计,减少了相互间的牵制,大大提高了设计、审批及地块开发效率,均衡了日照,提高了土地利用率,同时也为行政主管部门解决类似日照纠纷提供了量化依据,减少了日照纠纷。 During the planning and design of residential areas in high-density building areas,because many plots are adjacent to each other,the following problems of sunlight occlusion are often encountered during planning application:plots A and B of two different owners,and the construction of plot C in the planning and design.When conducting sunshine analysis,each calculation satisfies the national sunshine standard without shielding,and when applying for review,it is found that shielding occurs during joint calculation.In this case,how should the shielding time of each subject's rights and interests be divided?How to avoid such problems?This paper adopts the establishment of a theoretical model for analysis and research,and proposes the assumption that the shielding time of sunshine rights should be used as the sunshine design condition in the early stage of the plot,so that the adjacent plots can be independently designed in terms of sunshine conditions,and it is not necessary to jointly calculate the sunshine and jointly plan and design.It reduces mutual restraints,greatly improves the efficiency of design,approval and land development,balances sunshine,improves land utilization,and also provides a quantitative basis for administrative departments to resolve similar sunshine disputes,reducing sunshine disputes.
