劳动法治研究的价值意蕴、主题演进与未来趋势

Value Implication,Theme Evolution and Future Trend of Labor Rule of Law Research

劳动法治研究是法治现代化的重要方面,其中蕴含着丰富的价值意涵,既彰显劳动者利益至上的价值取向、凝铸为劳动法治现代化提供学理支撑的价值实践,又昭示着构建中国特色劳动法治话语体系的价值理想。新中国成立以来,随着我国劳动法治现代化实践加速推进,劳动法治研究取得丰硕成果。运用CiteSpace软件对CNKI数据库高影响力期刊论文进行可视化分析,能够探查新中国成立以来国内劳动法治研究主题的发展演进情况,进而对劳动法治研究的未来发展趋势作出预测。从国家治理现代化视角来看,未来劳动法治研究应当重点关注劳动法典理论、劳动法治基本概念和基础理论、劳动法治效能以及新型劳动权利保护四个方面,为中国式劳动法治现代化提供智力支持。

The study of labor rule of law is an important aspect of the modernization of the rule of law,which contains a wealth of value implications.It not only demonstrates the value orientation of workers’interests first,but also embodies the value practice of providing theoretical support for the modernization of labor rule of law,and also indicates the value ideal of constructing the discourse system of labor rule of law with Chinese characteristics.Since the founding of the People’s Republic of China,as the modernization practice of Chinese labor rule of law accelerates,the research on labor rule of law has gained substantial results.The visualization analysis of high-impact journal papers in CNKI database using CiteSpace software can probe the development and evolution of domestic labor rule of law research topics since the founding of PRC,and predict the future development trend of labor rule of law research.From the perspective of the modernization of national governance,future research on labor rule of law should focus on four aspects:the theory of labor code,the basic concept and theory of labor rule of law,the effectiveness of labor rule of law and the protection of new labor rights,so as to provide intellectual support for the modernization of Chinese style labor rule of law.
