摘要
社区团购产业在疫情肆虐时期异军突起,并在后疫情时代凭借其操作便利、价低质高继续蓬勃发展。然而,社区团购中黑心团长哄抬物价牟取高额利润、欺诈行为、食品安全违法行为、电商平台破坏公平竞争环境等问题愈发明显。社区团购作为数字经济时代下的一种新业态,相关立法尚未完善,监管内容尚未明确,社区团购中各主体之间的法律关系也未明晰。社区团购存在的传统监管模式滞后、监管内容不明确、责任主体不明晰、消费者权益难以保障等治理困境,可以从明确电商平台的义务、确立团长责任制、加强市场监管和探索多元化纠纷解决机制等方面着手解决。
Community group-buying industry emerged during the epidemic and continues to thrive in the post-epidemic era because of the easy operation,low good prices and high good qualities.However,some problems are much more evident such as price gouging for high profits by black-hearted group leaders,frauds,food safety violations,and fair competition disturbed by e-commerce platforms.Community group buying is a new industry in the era of digital economy,so the relevant legislation has not yet been perfected,the regulatory contents has not yet been clarified,and the legal relationship among various subjects of community group buying has not yet been clear.For the dilemmas such as the slow traditional regulatory mode,unclarified regulatory contents,unclear liability subjects,and non-protection of consumers’rights and interests,we should clarify the obligations of the e-commerce platforms,establish the group-leader-based responsibility system,strengthen market supervision and explore diversified dispute resolution mechanisms.
