Endogenous Development of Human Rights in Contemporary China

当代中国人权基于自身文化主体性而内生性发展,属于转型人权而非理念定型人权,是我国宪法规范的“民生性—民权型”人权形态,与西方的“政治性—分权型”属性相分殊。在使命型政党政治引领下,诸人权发展机制结构耦合、系统运作,具备极强的稳定秩序、转危为机和创新发展能力。当代中国宪法建基于“以人权联结国家与个人”“以人权成就人”的价值之上,成功将人权整饬为社会团结、行动有序和发展向善的建设性因素。中国“国家治理主义”文化传统与执政党的使命性、国家定位的积极职责性、宪法的行动纲领性相统一,催生出积极促进人权与司法救济人权并行的宪法模式;其以人民性为人权制度根基,以平等共享为人权原则,与严重单极化和深度内卷化的西方人权形成反思参照。

Human rights in contemporary China is developing endogenously because of their own cultural subjectivity,it belongs to transitional human rights rather than stereotyped human rights.They are different from the western attribute of“political-decentralization”in the attribute of“people's livelihood-civil rights”regulated by the Constitution.Under the rule of the Constitution,the human rights development mechanism with“mission-oriented political leadership”as the core is structurally coupled and systematically operated,with a strong ability to stabilize order,turn crises into opportunities,and innovate in development.The constitution of contemporary China is based on the values of“linking the nations and individuals with human rights”and“achieving human beings with human rights”.It has successfully restructured human rights into constructive elements of social solidarity,orderly action and development for good.The cultural tradition of“national governance”in China is unified with the mission of the ruling party,the positive responsibilities of the national positioning and the action program of the constitution,and has spawned a parallel constitutional paradigm of actively promoting human rights and judicial protection and relief of human rights.Taking people's nature as the foundation of the human rights system and equal sharing as the principle of human rights,it forms a reflection and reference for the western human rights which are seriously unipolar and deeply involute.
