生态系统方法视野下的环境法典编纂:方向与思路

Codification of Environmental Law from the Perspective of Ecosystem Approach:Direction and Thinking

现代环境治理发生着由分要素单独治理到以生态系统为基础的环境资源综合管理的深刻转变。环境立法须贯彻生态系统方法,从其实践原则中提炼法治要素、明确制度需求,转化为法律规范。生态系统方法与我国生态文明理论一脉相承、异曲同工,为我国环境立法完善指明了方向。环境法典编纂应贯彻生态系统方法,以全面实现生态系统管理为目标,确立“现实主义”编纂思路,以对相关重大瓶颈问题的突破解决为重点,发挥法典的基石作用和撬动效应,推动我国环境法治体系和能力的根本提升。

Modern environmental governance has undergone a profound transformation from separate management of elements to integrated management of environmental resources based on ecosystem.Environmental legislation must carry out the ecosystem approach,extract the elements of rule of law from its practical principles,clarify the system needs,and transform into legal norms.Ecological system method is in the same vein as the theory of ecological civilization,which points out the direction of improving environmental legislation.The codification of environmental law code should implement the ecosystem approach,with the goal of fully realizing ecosystem management,establish a"realistic"codification idea,focus on breakthrough solutions to major bottleneck problems,give play to the cornerstone role and leverage effect of the codification code,and promote the fundamental improvement of China's environmental legal system and capacity.
