黄河流域绿色发展法律协调机制研究

Study on Legal Coordination Mechanism of Green Development in Yellow River Basin

黄河流域的绿色发展需要法律协调机制的保障。黄河流域九省区都拥有各自的立法权,流域现行法律之间存在不协调性且各省区部门之间存在利益冲突,因此,各省区之间的地方性立法必然存在矛盾和冲突。且跨区域立法存在合宪性以及流域协议法治化程度不高等问题,会对黄河流域绿色发展产生不利影响。所以,应当建立一套长效的法律协调机制,用以协调解决各省区之间地方性立法存在的矛盾与冲突、协调各省区之间利益冲突、提高流域协议法治化程度、协调流域现行法律之间存在的冲突。同时,通过该机制以立法技术建立跨区域法律协调机制,九省区立法主体在同一时间通过相关法律,解决跨区域立法合宪性问题,实现沿黄九省区绿色健康发展。

The green development of the Yellow River basin needs the guarantee of legal coordination mecha⁃nism.The nine provinces and regions in the Yellow River Basin all have their own legislative power,there is incompatibility between the current laws in the basin,and there are conflicts of interests among the prov⁃inces and regions.Therefore,there are inevitably contradictions and conflicts in the local legislation among the provinces and regions.Moreover,the cross-regional legislation has constitutionality and the low degree of legalization of watershed agreements,which will have adverse effects on the green development of the Yellow River basin.Therefore,A set of long-term legal coordination mechanism should be established to coordinate and solve the contradictions and conflicts of local legislation among provinces,coordinate the conflicts of interests among provinces,improve the degree of legalization of watershed agreements,and co⁃ordinate the conflicts between current watershed laws.At the same time,the legislative body of nine prov⁃inces and regions will pass relevant laws at the same time to solve the constitutionality of trans-regional legislation and realize the green and healthy development along the Yellow nine provinces and regions.
