粤港澳大湾区社会治理的法治共建的问题与途径

Co-Building the Rule of Law for Social Governance in the Guangdong-Hong Kong-Macao Greater Bay Area:Problems and Paths

从目标定位与实施路径来看,加强粤港澳大湾区社会治理合作必然是一项法治共建的系统工程。法治共建是多元主体在法治的框架之内跨区域跨制度、多层次多形式地构建大湾区社会治理共同体的过程。大湾区社会治理的法治共建面临着立法、行政与司法的多种困难与限制。应当在遵守“一国两制”和法治的前提下,通过理论与制度创新,寻求法治共建的最大公约数,逐步通过建立区域立法机制、协同立法,建立依法行政的治理体系和加强司法协助共建的途径,实现更高层次的社会治理合作目标,促进大湾区融合发展。

From the perspective of target orientation and implementation path,social governance cooperation in the Guangdong-Hong Kong-Macao Greater Bay Area must be a systematic co-construction of the rule of law,which means building a community of social governance in the Greater Bay Area at multiple levels and in multiple forms across regions and systems under the rule of law.It faces many difficulties and limitations in legislation,administration and judicature.On the premise of abiding by“one country,two systems”and the rule of law,we should seek the maximum common divisor through theoretical and institutional innovation,and gradually achieve the goal of higher-level social governance cooperation through regional legislative mechanism,collaborative legislation,legal governance system and the co-construction of judicial assistance,so as to promote the integrated development of the Greater Bay Area.
