自动驾驶数据安全的沙盒监管构造

摘要 当前自动驾驶数据安全尚未建立体系化的科学监管模式,不利于维护国家安全和保护公民个人信息。监管主体多元化、监管对象标准不清晰、监管过程局部化等问题在实践中比较突出。五部门联合发布的《关于试行汽车安全沙盒监管制度的通告》引入“沙盒监管”的模式,在自动驾驶数据安全领域值得进一步展开应用。具体而言,可在国家市场监管总局下设大数据与人工智能委员会作为专责监管机关,对于自动驾驶数据实施分级分类和全过程监管,通过监管手段的组合适用以实现监管目的。 At present,the data security of autonomous vehicle has not yet established a systematic scientific supervision model,which is not conducive to maintaining national security and protecting citizens personal information.Problems such as diversification of supervisory bodies,unclear standards of supervisory objects,and localization of supervisory processes are more prominent in practice.“Notice on Trial Implementation of the Automotive Safety Sandbox Supervision System”jointly issued by the five departments introduces the“sandbox supervision”model,which is worthy of further application in the field of autonomous vehicle data security.Specifically,the Big Data and Artificial Intelligence Committee can be set up under the State Administration for Market Regulation as a dedicated supervisory authority to implement classification and whole-process supervision of autonomous vehicle data,and achieve the purpose of supervision through the combination and application of regulatory means.
