Multimodal Attitude Analysis of Attorneys' Closing Arguments and Narrative Construction

多模态话语分析为法律话语研究提供了一个新视角。在庭审结辩中,控辩律师调用多模态资源呈现证据、论证观点、表达立场,以实现交际意图。本文聚焦于美国弗洛伊德案庭审结辩话语,以马丁等人提出的态度系统及副语言类别为分析框架,借助UAM Corpus Tool和Praat软件对庭审中的语言及副语言信息进行质性标注和量化分析,探讨控辩律师结辩话语的多模态表征。研究结果表明,控辩律师使用不同的语言和副语言等多模态资源表达对不同评价对象的态度,由此建构不同的叙事版本,进而以看得见的方式彰显司法正义。

Multimodal discourse analysis provides a new perspective for the study of legal discourse.In the closing arguments of the trial,the prosecution and defense attorneys deploy multimodal resources to present evidence,demonstrate views,and take stances in order to achieve their communicative intentions.Focusing on the closing arguments in the trial of George Floyd case,this paper builds an analytical framework based on the attitude system and paralinguistic categories proposed by Martin et al.,qualitatively annotates and quantifies the language and paralinguistic information in the trial with the help of UAM Corpus Tool and Praat,and analyzes the multimodal representation of the case by both the prosecution and defense attorneys in their closing arguments.This research shows that the prosecution and defense attorneys utilize different multimodal resources such as language and paralanguage to express their attitudes towards different participants,thus constructing different narratives and demonstrating how justice is seen to be done.
