The Innovation and Approach of Social Organization to Solve Family Disputes

解决家事纠纷是社会组织参与社会治理的一项重要内容。社会组织以修复家庭关系、社会关系为目标,主要应对家事纠纷“法化”过剩,修复当事人人际关系、维护当事人“法外”正当利益,进而培育和践行社会主义核心价值观,降低家事纠纷解决成本。由于尚未建立解决家事纠纷的专业社会组织网络,未形成完备的社会组织解决家事纠纷工作机制,社会组织解决家事纠纷还面临着诸多困境。在当下及未来,应当大力发展专业社会组织,革新传统“背靠背”“和稀泥”式的家事调解理念与模式,树立弱势群体利益保护和家庭治疗解决理念,并在该理念的指导下开展具体行动。

Social organizations solving family disputes is an important content of social organizations participate in social governance,to repair the family relations,social relations as the goal,which is benefits to coping with excess family disputes legalization,repairing relationships,maintaining illegal legitimate interests,cultivating and practicing socialist core values,reducing the cost of the family dispute resolution.However,as the professional social organization network for solving family disputes has not been established and a complete working mechanism for social organizations to solve family disputes has not been formed,social organizations are still facing many difficulties in solving family disputes.At present and in the future,we should vigorously develop professional social organizations,innovate the traditional concept and mode of"back-to-back"and"mud"family mediation,establish the concept of protecting the interests of vulnerable groups and solving family therapy,and carry out specific actions under the guidance of this concept.
