元宇宙视域下国际私法管辖权规则适用的困境及纾解

The Dilemma and Relief of the Application of Jurisdiction Rules of Private International Law from the Perspective of Meta-Universe

元宇宙是西方互联网巨头提出的新概念,是指网络技术下人类社会的一种与现实世界映射交互的数字平行空间。因超越传统意义上的地理边界,国际民商事交流日益频繁,以地域与当事人国籍为基础的传统管辖规则受到沉重打击,元宇宙的高度开放与复杂多变将会为国际私法管辖权带来前所未有的挑战,且极有可能成为继互联网革命之后的又一次伟大革新。面对如此困境,应当结合元宇宙当前发展状况及其主要特征,试图寻找相关纾解对策,确定在元宇宙中适用的管辖权理论,制定切实有效的规则制度,加强国际合作与协调,坚持自治为主,法治为辅的原则,实现虚实相融,虚实共生。

Metaverse is a new concept proposed by Western Internet giants,which refers to a kind of digital parallel space of human society under the network technology and mapping interaction with the real world.The international civil and commercial exchanges are becoming more and more frequent because the geographical boundaries are beyond the traditional sense,and the traditional jurisdiction rules based on the region and nationality of the parties have been dealt a heavy blow.The high openness and complexity of the meta-universe will bring unprecedented challenges to the jurisdiction of international private law,and it is very likely to become another great innovation after the Internet revolution.In the face of such a dilemma,we should combine the current development status of the meta-universe and its main characteristics,try to find relevant relief measures,determine the applicable jurisdiction theory in the meta-universe,formulate practical and effective rules and institutions,and strengthen international cooperation and coordination.Adhere to the principle of autonomy as the primary,supplemented by the rule of law,and realize the integration of virtuality and reality,and the coexistence of virtuality and reality.
