能动检察理念下的提前介入工作改革进路——从新时期检警关系的优化说开去

Advance Intervention Mechanism Reform Under the Concept of Procuratorial Activism--Base on Optimization of the Relations Between Prosecutors and Police in the New Times

侦查监督与协作配合机制的健全完善,优化了新时期检警监督协作关系,与以审判为中心的诉讼制度改革的发展趋势契合,也为检察机关能动履职,加强新时代法律监督工作,提供良好契机。能动检察理念是在宪法赋予的法律监督权力框架下回应法律监督,提前介入并开展能动检察亦是实现多元诉讼价值目标之应然逻辑。在能动检察背景下提前介入工作存在检警关系不协调、能动界限不明、实质介入不力、队伍建设不足等问题。在侦查监督与协作配合机制下完善提前介入工作,检察机关要把握好提前介入的“度”,建立良性互动的侦查监督与协作配合检警关系,规范介入的程序运作,加强专业化队伍建设,充分发挥检察能动作用,实现该制度的功能和价值。

The perfection of investigation supervision and cooperation mechanism optimizes the supervisory cooperation relationship between prosecutors and police in the new times,fits in with the development trend of the trial-centered litigation system reform,and provides a good opportunity for the procuratorial organs to actively perform their duties and strengthen the legal supervision work in the new times.The concept of procuratorial activism is to respond to legal supervision under the framework of legal supervision power endowed by the Constitution.Procuratorial activism in the advance intervention stage is also the necessary logic to achieve the goal of multiple litigation values.Under the background of procuratorial activism,the mechanism of advance intervention has such problems as uncoordinated relationship between procurators and police,unclear boundaries of initiative,ineffective substantive intervention and insufficient team building.In order to improve the mechanism of advance intervention under the mechanism of investigation supervision and cooperation,the procuratorial organs should grasp the“degree”of the mechanism of advance intervention;establish a benign interactive relation between prosecutors and police;standardize the advance intervention procedures;strengthen the building of professional teams;give full play to the active role of procuratorial work;and realize the function and value of the system.
