从系统论视角看司法公信力建设

The Construction of Judicial Credibility:A Perspective of System Theory

系统论认为,一个系统是由许多子系统组成的,而各个子系统又各有其目的。假如把司法公信力建设看成一个整体的系统,那么可以说立法系统、决策系统、司法系统、行政系统、社会组织系统、监督系统则分别是它的子系统,这些子系统都在自身所处的范围内发挥独特的作用。在司法公信力建设方面,立法系统发挥基础作用,决策系统发挥领导作用,行政系统发挥支撑作用,司法系统发挥主体作用,监督系统发挥监督作用,社会组织系统发挥辅助作用,等等。这些子系统共同作用的结果,便形成一种合力,一起促进司法公信力建设。传统上,一般将司法公信力建设当成司法机关“单打独斗”的事情,这种看法是偏颇的。司法是由法治理想转化为法治现实的关键环节,司法改革也是实现中国式法治现代化的关键步骤,而司法改革的主要目标是建构一种具有广泛公信力的司法系统,这一系统的最终形成,不仅昭示着司法文明的进步和完善,也标志着中国式法治现代化的实现与成熟。

System theory holds that a system is composed of many subsystems,and each subsystem has a clear purpose.If we regard the construction of judicial credibility as a whole system,the decision-making system,the justice system,the administration system,the social organization system,the legislature system and the supervision system constitute this whole system.The common goal of these subsystems is to enhance judicial credibility.In order to achieve this goal,each component plays a unique role in its own system and scope.Specifically speaking,in the construction of judicial credibility,the legislation system plays a fundamental role,the decision-making system plays a leading role,the administration system plays a supporting role,the justice system plays a fundamental role;the supervision system plays a supervisory role,and the social organization system plays an auxiliary role,etc.These subsystems work together in order to promote the construction of judicial credibility.In the past,the construction of judicial credibility was generally regarded as“an independent cause”of the judicial authority,but this view is not comprehensive.Justice is the key link in the transformation of the ideal of the rule of law into the reality of the rule of law,and judicial reform is the key step in realizing the modernization of Chinese rule of law.The basic goal of judicial reform is to construct a judicial system with broad credibility in the whole society.The final formation of this system not only marks the progress and perfection of judicial civilization,but also shows the realization and maturity of the modernization of Chinese rule of law.
