我国油气矿业权竞争性出让改革试点探析

Discussion and Analysis on the Competitive Transfer Reform of Oil and Gas Mining Right in China

实践证明,油气矿业权竞争性出让改革有利于发挥市场在资源配置中的决定性作用。文章梳理了我国油气矿业权管理方式和发展沿革,分析总结了油气矿业权竞争性出让改革试点实践情况,指出油气矿业权试点改革证实了竞争性出让充分可行、打破了从业企业资格限制、助推了国有石油企业参与油气体制改革,但同时还存在经济和技术风险过高、过高的行业门槛限制非油企业参与、矿业权价值评估体系和技术资料缺乏、增加政府职能部门管理工作压力等问题。文章针对存在的问题提出完善矿业权出让制度体系、合理化设置出让条件、推进多元合作模式、建立专业监管团队等政策建议。

It has proved by practice that the reform of competitive transfer of oil and gas mining rights is conducive to giving play to the decisive role of the market in resource allocation.This paper presents the management mode and development evolution of gas and oil mining right in China,analyzes and summarizes the pilot practice of the reforming the competitive transfer of oil and gas mining right.Then this paper points out that the pilot reform of oil and gas mining right proves that the competitive transfer is feasible,breaks the qualification restriction of enterprises,and helps state-owned petroleum enterprises participate in the oil and gas system reform.However,at the same time,there are also high economic and technical risks,overhigh industry threshold limits non-oil enterprises to participate in,mining right value evaluation system and technical data lack,increasing the pressure on government functional departments management and other problems.Given the existing problems,the paper puts forward some policy suggestions,such as improving the transfer system of mining rights,rationalizing the transfer conditions,promoting diversified cooperation modes,and establishing professional supervision teams.
