全球竞争视阈下规制知识产权滥用的反垄断法思考

随着知识经济的不断发展,知识产权在全球经济竞争中愈显关键。在经济全球化发展中经济竞争愈发纷繁复杂,知识产权不正当使用导致的垄断行为也日渐凸显。知识产权和竞争政策不仅是国别问题,更是全球性问题。经济全球化使知识产权和竞争政策不再是一个国家内部的法律工具和政策手段。此背景下保护知识产权、限制滥用行为已成为提升经济活力、推动行业创新的重中之重,反垄断法既接受知识产权的合法行使对竞争秩序的合理影响,也会对不正当行使知识产权的行为进行约束与惩处,以保证市场竞争的正常有序开展。为破解全球竞争视角下反垄断法规制知识产权滥用面临的难题,不仅要遵循全球竞争法基本原则,维护自由和公平竞争,还应持续加强规制知识产权滥用的区域性合作。最后,应制定和实施与社会主义市场经济相适应的竞争规则,健全统一、开放、竞争、有序的市场体系。

The integrated development of urban and rural areas is the key link between the city and the countryside,is an important content of Chinese modernization.Based on the new development stage,the Chinese-style modernization path has given new meaning to integrated urban and rural development,it is mainly reflected in the profound connotation of the integration of urban and rural areas,which insists on the Party's leadership as the fundamental guarantee,the people-centered concept as the starting point and landing point,the realization of social equity and justice as the value guidance,and the coordination of“two civilizations”as the internal requirement.The relationship between urban and rural areas during the course of our socialist modernization construction has roughly experienced three periods:Construction of urban-rural dual development of socialist public ownership in the process of“Four modernizations”,the overall development of urban and rural areas in the process of the“Four modernizations of Chinese style”strengthens the economic foundation,the integrated development of urban and rural areas in the process of“Chinese-style modernization”promotes modernization in an all-round way,the evolution of urban-rural relations from division to integration reveals the practical experience of promoting Chinese modernization with urban-rural integration in different periods.In the future,in terms of practice,we should focus on the development goal of Chinese-style modernization,and comprehensively promote agricultural and rural modernization by integrating urban and rural power,economy,culture,organization and ecology.
