高校图书馆引进国外数字资源的合同风险管理现状及优化策略

The Current Situation and Optimized Strategy of Contract Risk Management for the Importing Foreign Digital Resources in University Libraries

加强对高校图书馆引进国外数字资源的合同风险管理,不仅来源于实践的迫切需求,更是党中央全面依法治国以及教育部全面依法治校要求在基层工作中的具体落实。在问卷调查和大量合同文本调研基础上,结合业务实践和教育部对高校法治及内控制度建设的最新要求,从深化合同管理制度的建设、优化合同管理岗位设置、加强合同条款风险的识别与防控、构建有效的合同验收体系、实现合同风险的全流程规范管理五个方面,对高校图书馆引进国外数字资源的合同风险管理提出优化建议和策略,以期对图书馆合同风险防控能力的提升有所助力,更好地维护图书馆及数字资源用户的权益。

Strengthening contract risk management when importing foreign digital resources in university libraries is not only an urgent practical need,but also a concrete implementation of the requirements for comprehensive governance of the country by law.This is also in line with the Ministry of Education s comprehensive administration of schools according to the law at the grassroots level.Based on an analysis of questionnaire surveys,a large number of contracts,current business practices,as well as the latest requirements from the Ministry of Education regarding the rule of law and internal control in universities,this paper proposes strategies for optimizing the management of contract risks associated with the importation of foreign digital resources in university libraries.The suggestions are presented in five aspects:deepening the construction of the contract management system,optimizing the post settings of contract management,strengthening the identification and prevention of contract term risks,constructing an effective contract acceptance review system,and achieving effective implementation.Standardized management of the entire contract process can help improve the library s ability to prevent and control contract risks,thereby better safeguarding the library and its digital resource users.
