人民法院司法政策听证制度构建探究

A Research on the Construction of the Judicial Policy Hearing System of the People’s Court

人民法院在制定司法政策的过程中引入公开听证可以有效实化人民群众的司法知情权、参与权、表达权和监督权,这对规范司法行为和提升司法公信具有重要意义。其制度构建应当以提高司法政策水平与增强人民群众公平获得感相统一为出发点,坚守听证主体分类设定、听证代表随机产生、说明人诚实答问、听证内容过程公开和听证意见采舍结果反馈5个落脚点,明确听证适用范围、听证主题和听证事项的确定规则,明确听证主体的“双边四方一主线”关系及其产生条件与方式,明确以听证会为核心的3阶段程序,以此形成法院司法政策听证制度的基本框架与主要内涵。

The introduction of public hearing into the process of formulating judicial policies of the people’s courts can effectively realize the people’s judicial right to know,to participate,to express and to supervise,which is of great significance for the standardization of the judicial behavior and the improvement of the judicial creditability.The system construction should adhere to the starting point of the unity of the basic goal of improving the level of judicial policy and the ultimate effect of enhancing the people’s sense of fairness access,and adhere to the five main points of the hearing subject classification,the random selection of the hearing representatives,the honest answering of the expositors,the open process of the hearing content,and the feedback of hearing opinions.The basic framework and main connotation of the judicial policy hearing system of the court can be established through defining the determination rules of the application scope of hearing,the theme of hearing,and the matters of hearing,clarifying the“bilateral,four parties and one main line”relationship between the hearing subjects and its conditions and means,and deciding the three-stage procedure with the hearing as the core.
