近年来专利申请质量不高导致科技成果转化率不高,直接影响创新驱动发展战略的实施和推进。专利申请前评估制度是提升专利申请质量,促进科技成果转化的一项制度创新。专利申请前评估不只是做出职务发明创造的专利申请与否的决定,还承担反馈控制专利申请质量的使命。专利申请质量由申请专利的技术创新水平和专利申请的文件撰写水平决定。在探讨专利申请前评估基础内涵的基础上,提出基于专利申请保护范围的专利申请前评估框架和评判标准,以期进一步完善科技成果转化的法律机制,为创新驱动发展战略的实施建立一个良好的制度生态。

China’s low transformation rate of scientific and technological achievements directly hinders the implementation and promotion of innovation-driven development strategies.Pre-Patent Evaluation is a system innovation to improve patent application quality and to promote the scientific and technological achievement transformation.In addition to deciding patent application approval or denial of the service invention-creation,Pre-Patent Evaluation also shoulders the responsibility of patent application quality feedback and control.The patent application quality is determined by the technological innovation level of the applied patent and the patent application document writing quality.Based on an exploration of the basic Pre-Patent Evaluation connotations,this paper puts forward the basic framework and specific criteria for evaluation based on the patent application protection scope.It means to perfect the legal mechanism of the scientific and technological achievement transformation and to protect the innovation-driven development strategy realization.
