Research on Forensic Identification Problems in Construction Project Contract Dispute Cases

建设工程施工合同纠纷案件中,工程造价、工程质量、修复费用等均为专门性问题,法院在审判实践中更是经常需要借助鉴定机构出具的鉴定意见来认定案件事实。但在具体审判实践中,关于鉴定程序的启动、负有举证责任的当事人的确定及确定鉴定所依据的鉴定材料等方面均存在这样或那样的问题。基于此,应当构建对当事人鉴定申请的审查程序,以避免不当启动鉴定程序;应当结合案件具体情况,判断对鉴定事项负有举证责任的当事人;应当发挥证据制度作用,全面收集鉴定材料,充分听取当事人意见,质证、认证实质化以确定鉴定所依据的材料。

In the cases of construction project contract disputes,the project cost,project quality,repair cost and the like are all specialized issues.In the trial practice,the court often needs to rely on the expert opinion issued by the expertise organization to determine the facts of the case.However,in the specific trial practice,there are some problems such as the initiation of the identification procedure,the determination of the parties who bear the burden of proof,and the determination of the materials on which the identification is based.The author believes that a review procedure for the identification application of the parties should be established to avoid improper initiation of identification procedures,that the parties who bear the burden of proof for identification matters should be judged in light of the specific circumstances of the case,the role of the evidence system should be brought into play,the identification materials should be comprehensively collected,the opinions of parties should be fully heard,and cross-examination and certification should be substantiated to determine the materials on which the identification is based.
