环境行政公益诉讼井喷式增长之省思

Reflections on the blowout growth of environmental administrative public interest litigation

我国环境行政公益诉讼近年来呈井喷式增长态势。在分析环境行政公益诉讼井喷式增长成因的基础上,指出环境行政公益诉讼井喷式增长潜在的问题,即检察机关具有自利性倾向难免有失公正,检察监督具有运动式司法的特点难以保证可持续性,检察权具有行政化倾向难以保证司法的谦抑性。环境行政公益诉讼良性发展的进路是:法律应明确环境行政公益诉讼的起诉要件,检察机关要尊重环境行政机关的行政权,检察机关要恪守司法的谦抑性品格,法律应明确行政机关违法行使职权或者不作为的标准。

In recent years,China’s environmental administrative public interest litigation has shown a blowout growth trend.Analyzing the causes of the blowout growth of environmental administrative public interest litigation,it points out the potential problems of the blowout growth of environmental administrative public interest litigation:the procuratorial organs are inevitably unfair with self-interest tendency;the procuratorial supervision has the characteristics of sports justice;it is difficult to ensure the sustainability and the procuratorial power has the tendency of administration,which is difficult to ensure the modesty of justice.Finally,the paper puts forward the regulation strategies for the benign development of environmental administrative public interest litigation:the law should clearly define the prosecution elements of environmental administrative public interest litigation;the procuratorial organs should respect the administrative power of environmental administrative organs;the procuratorial organs should abide by the judicial modesty and the law should clearly define the standards for administrative organs to exercise their functions and powers illegally or not.
