长江流域生态环境协同共治:理论溯源、核心要义与体制保障 被引量:2

摘要 因应现代环境治理体系建构的时代要求,《长江保护法》将凝萃于政治、经济、社会等诸多学科的思维范式——“协同共治”作为方式变项嵌入流域生态环境治理模式中,以塑造长江流域生态法治的话语体系与规范秩序。作为推进长江流域生态环境治理体系、治理能力现代化的科学方法,流域环境协同共治对整体政府理论的遵循、对成本效益分析理论的践行以及对治理理论的运用,构成了一个成熟且自洽的理论框架。长江流域生态环境协同共治的规范意涵包括主体上的多元共治、客体上的要素整合以及过程上的效力变革三重维度内容。在实现进路方面,《长江保护法》将“长江流域协调机制”作为驱动流域生态环境协同共治目标实现的根本体制保障,通过信息赋能与智慧赋能二元规范构造的形式,充分挖掘流域协调机制在流域事权配置上所具有的统筹、协调与监督三大价值功能,以切实增进长江流域环境利益的互惠与共享。 In response to the requirements of the Times in the construction of modern environmental governance system,the Yangtze River Protection Law embedded the thinking paradigm—“collaborative governance”,which is embodied in many disciplines such as politics,economy,and society,into the ecological environment governance model of the river basin,so as to shape the discourse system and normative order of the ecological rule of law in the area.As a scientific method to promote modernization of ecological environment governance system and governance capacity in the Yangtze River basin,the river basin environment coordination and co-governance on the adherence to the overall government theory,the practice of the cost-benefit analysis theory and the application of the governance theory constitute a mature and self-consistent theoretical framework.The normative meaning of ecological environment co-governance in the Yangtze River basin includes multiple factors as co-governance in the subject,the integration of elements in the object and the effectiveness change in the process.In terms of implementation route,the Yangtze River Protection Law will take“Yangtze River basin coordination mechanism”as a fundamental system guarantee for realizing coordinated and collaborative governance of the river basin,and,by means of the dual construction of information technologies and intelligence application,the three value functions of holistic planning,coordination and supervision in areas of task configuration are to be materialized for them to promote mutual benefits and interests within the area.
