国家安全视域下的数据出境合规体系研究——以国内首例涉案数据被鉴定为情报案为例

Study on the Data Cross-Border Compliance System from the Perspective of National Security:Taking the First Domestic Case of Data Involved Being Identified as Intelligence as an Example

[研究目的]数据出境合规既是数据企业的风险内控,也是总体国家安全观视角下政企数据共治的应然走向,因此,亟需根据数据出境的特性,研究构建起一套以数据安全为核心的出境合规体系。[研究方法]通过典型案例的引入,明确数据出境的情报风险,并在此基础上运用法学与情报学的知识体系,为数据出境合规体系的建构提供新的研究视野。[研究结论]在合理、开放、动态的安全观视域下,通过数据出境合规体系建设,完善和落实数据出境的全流程合规及救济机制,进而防止因不合规的数据交易而产生的法律风险和国家安全风险。

[Research purpose]Data exit compliance is not only the internal risk control of data enterprises,but also the inevitable trend of data co-governance between government and enterprises from the perspective of overall national security concept.Therefore,it is urgent to study and build a set of exit compliance system with data security as the core according to the characteristics of data exit.[Research method]Through the introduction of typical cases,the information risk of cross-border data exit is clarified.Then,using the knowledge system of law and information science,it provides a new research horizon for the construction of data exit compliance system.[Research conclusion]In the view of reasonable,open and dynamic security concept,through the construction of data cross-border exit compliance system,full-process compliance and relief mechanism of data outbound should be improved and implemented,so as to prevent legal risks and national security risks caused by non-compliant data transactions.
