危险房屋鉴定工作相关法规规定若干问题探讨

Discussion on Some Issues Related to Laws and Regulations of Dangerous Building Appraisal

根据我国有关政府部门、省、直辖市制定的行政法规、制度及技术标准等,探讨了危险房屋鉴定工作的几个问题,重点讨论了危险房屋鉴定工作的适用条件、房屋使用安全责任人、鉴定机构及危险房屋鉴定活动等问题;指出不应混淆房屋危险性与安全性鉴定在其概念和本质上的差别。现有房屋安全性和危险性鉴定仍存在诸多法律问题与技术问题,相关政府部门应尽快协调有关法律、法规及技术标准之间的冲突,为房屋安全使用提供法律及技术保障。

According to the administrative regulations,systems and technical standards formulated by relevant departments,provinces and cities of China,this paper discusses several problems in the appraisal of dangerous building,focusing on the scope of application of the appraisal of dangerous building,the person in charge of safety,appraisal institutions and appraisal activities of dangerous building;It is pointed out that the differences in concept and essence between building risk identification and safety identification should not be confused.There are still many legal and technical problems in the existing building safety and risk identification.The relevant departments should improve the conflict between relevant laws,regulations and technical standards as soon as possible to provide legal and technical guarantee for the safe use.
