摘要
儿童出版物的内容问题可以归纳为三类:不合法,即违反法律规定;不正确,包括价值观错误和知识性错误;不适宜,包括不文明和审美不足。这三类问题应当分别依据三类正当原则予以纠正:合法原则,即应当遵守法律规定;合理原则,即符合核心价值观与科学常识;儿童利益最大化原则,即最大程度保护儿童利益。纠正儿童出版物中的不正当内容,需要四方面的制度保障:监督主体多元化,检查程序公开化,退出机制实效化,司法活动规范化。
Children publications’content has illegal incorrect and inappropriate problem,which means violating legal provisions,existing value and intellectual errors,and showing uncivilized and unaesthetic.These three types of problems should be corrected according to three types of justified principles:legality reasonableness and maximizing the interests of children,which means children publication content should obey the legal provisions,conform with core values scientific and common sense,and protect the interests of children as much as possible.Correcting unjustified content in children publications requires various institutional safeguards,mainly from the following four aspects:diversification of supervisory bodies,open inspection procedures,effective withdrawal mechanisms,and standardization of judicial activities.
