Discussion on the Scope of Supervision of Special Purpose Motor Vehicles in Special Fields

场(厂)内专用机动车辆安全监督管理范围界定不清晰是目前困扰基层特种设备监管部门的问题,本文从历年场(厂)内专用机动车辆安全监管政策和现行法规标准研究以及使用现状调研中,归纳分析了安全监管范围边界的争议之处,提出以《中华人民共和国特种设备安全法》为主线和以《特种设备目录》为依托、强化使用主体责任落实、保持政策连续性的界定原则。并提出界定方案,供相关部门参考。

The unclear definition of the safety supervision and management scope of special purpose motor vehicles in special fields is a problem troubling the grassroots special equipment supervision departments at present.This paper summarizes and analyzes the disputes on the boundary of the safety supervision scope of special purpose motor vehicles in special fields from the studies on the safety supervision policies,current regulations and standards and the research on the use status.The definition principle of strengthening the implementation of user responsibility and maintaining policy continuity is put forward based on Special Equipment Safety Law of the People’s Republic of China and Special Equipment Catalogue.And put forward the definition scheme for the reference of relevant departments.
