帮助信息网络犯罪活动罪的明知推定规则在跨境信息网络犯罪高发的背景下,一定程度上遏制了信息网络犯罪的猖獗态势,取得了卓有成效的社会治理效果。但同时,应当承认,在我国当前刑事诉讼控辩双方的力量和地位尚不对等的背景下,该规则的实施可能会导致被追诉人额外承担证明责任,使当下控辩关系进一步失调,并且可能在部分案件的审理中出现与无罪推定原则相冲突的局面,不利于实现权利保障和惩罚犯罪的动态平衡。为此,必须对帮助信息网络犯罪活动罪的明知推定规则进行包容性规制,在对推定的情形予以审慎规定的同时,尝试对印证证明模式进行逐步的、谨慎的探索革新,提高技术与法律相融合的程度,以实现刑事政策目的和保障人权使命的协调统一。

Under the background of the high occurrence of cross-border cybercrime,the knowingly presumption rule for crime of assisting cybercrime has curbed the rampant situation of cybercrime to a certain extent and achieved fruitful social governance results.But at the same time,it should be admitted that in the current criminal procedure activities in China,the balance of power between the prosecution and the defense is not balanced enough,and the implementation of this rule may cause the accused to bear additional burden of proof,making the current relationship between prosecution and defense further maladjusted.And it may conflict with the principle of presumption of innocence in some cases,which is not conducive to realizing the dynamic balance between the protection of rights and the punishment of crimes.Therefore,it is necessary to make inclusive regulation on the presumption rule for crime of assisting cybercrime.While carefully regulating the presumption situation,it is necessary to try to gradually and cautiously explore and innovate the mode of proof,and improve the degree of integration between technology and law,so as to realize the coordination and unity of the purpose of criminal policy and the mission of safeguarding human rights.
