党内法规执行效果评估主体模式优化研究

Research on the Optimization of the Main Body Model for Evaluating the Implementation Effect of the Inner-Party Laws and Regulations

评估主体是党内法规执行效果评估体系的首要构成要素,直接影响党内法规执行效果评估成效。在党内法规执行效果评估实践中已形成内部评估主体模式、外部评估主体模式和综合性评估主体模式。受党内法规制定机关、党内法规执行机关和第三方评估主体的影响,三类评估主体模式各有利弊,不能适用于所有党内法规执行效果评估。应在借鉴立法后评估有益经验的基础上,依规明确各类主体的评估资格,吸纳党员和民众参与,优化评估主体模式的设置,适用不同类型党内法规执行效果评估工作。

The evaluation subject is the primary component of the evaluation system of the implementation effect of the Inner-Party's Laws and Regulations,which causes direct effect on the evaluation toward the implementation of the Inner-Party's Laws and Regulations.The internal evaluation mode,external evaluation mode and comprehensive evaluation mode are the three modes.Influenced by the respective characteristics of the in-party legislation institution,in-party executing institution and the third-party evaluation subjects,these modes hold their own advantages and disadvantages,cannot be applied to all circumstances in practice.Base on the beneficial experience from the legislating process,we ought to enhance the settings of the above models by defining the evaluation qualifications on various subjects in accordance while attracting ordinary party members and the public to participate in,adapt to the evaluation process of various types of the Inner-Party's Laws and Regulations respectively.
