论立法联系点制度——兼论全过程人民民主立法的基层问题

On the System of Legislative Contact Point:A Grassroots Practice of Overall Process of People’s Democracy in Legislative Process

全过程人民民主是新时代国家治理过程的新型民主诠释,在国家立法治理的环节、内容、主体三个面向中都表现出了新的民主诉求。基层立法联系点制度就是全过程人民民主在立法进程中的微观民主践行,在理论架构、制度贡献中蕴含着人民当家作主和全过程人民民主的制度基础,在立法流程、立法涉及、立法面向上回应着全过程人民民主的制度要求,在群众意见的全链条融入、全方位参与下表达着全过程人民民主的制度展望。在加强基层立法联系点建设中厘清其全过程人民民主的理论基础、现实表达和发展进路可以进一步夯实全过程人民民主在国家法治建设中的理论作用,实现立法的民主贯彻和依法治国的全面推进。

The overall process of people’s democracy is a new type of democracy that has emerged in the process of state governance in the new era.It embodies a new democratic demand of state legislation in terms of governance link,content,and subject.The system of grassroots legislative contact point is a microcosmic democratic practice of the overall process of people’s democracy in the process of legislation.Its theoretical framework and institutional contribution contain the systemic foundation of people running the country and overall process of people’s democracy;its legislative process,legislative concern,and legislative direction respond to the institutional demands of overall process of people’s democracy;and the fullchain integration and all-round participation of the masses’opinion represent the institutional expectation of overall process of people’s democracy.In enhancing the construction of grassroots legislative contact points,it is necessary to clarify the theoretical basis,realistic expression,and development route of overall process of people’s democracy.The clarification can further strengthen the theoretical role of overall process of people’s democracy in state rule-of-law construction,actualize democracy in legislation,and comprehensively boost law-based state governance.
