中国式现代化背景下基层信访法治化建设研究

Research on the Legalization of Grassroots Petitioning in the Context of Chinese-Style Modernization

中国式现代化要着力维护和促进社会公平正义,基层法治是国家法治的基础,当前基层治理的信访工作是基层法治化建设的重要领域。当前信访法治化建设面临着信访制度异化、“无理上访”横向带动、信访法治化缺失导致公平公正社会环境受到破坏等现实困境;当前导致信访法治化缺失的原因,有国家在信访制度供给层面呈现不足、基层政府在制度执行层面能力不足、制度受众层面个体权利至上不断泛化等;要提升信访法治化建设,就必须重视制度供给,推动机制创新、增强治理能力,提升信访公信力、构建信通访和的信访文化。

Chinese-style modernization aims to maintain and promote social fairness and justice,and grassroots rule of law serves as the foundation of national rule of law.The petition work in grassroots governance is an important area for constructing the grassroots legalization process.At present,the legal construction of petitioning faces practical challenges,such as the alienation of petition systems,the horizontal spread of"irrational petitioning,"and the absence of legal petitioning,which damages the fair and just social environment.The reasons for the lack of legal petitioning include insufficient supply at the national level,inadequate execution capabilities at the grassroots government level,and the continuous generalization of individual rights over the system's audience.To enhance the legalization of petitioning,it is necessary to pay attention to system supply,promote mechanism innovation,strengthen governance capabilities,improve the credibility of petitions,and construct a petition culture characterized by smooth communication and harmony.
