宪法语篇英译中级差系统的显隐化研究

摘要 立法语篇规定国家和地方的规章制度,而宪法语篇具有根本性地位,是其他立法语篇的指定依据。以往立法语篇的翻译研究主要从词汇层面关注翻译主体的态度表达和介入,但对其态度介入的程度关注有限。本文选取我国宪法及其英译文进行探索,在系统功能理论学的视域下运用评价理论,对我国宪法及其英译文的级差系统进行对比分析,考察机构语境对翻译主体态度介入程度的影响,经统计、分析表明:宪法英译文与宪法原文的级差系统比重基本趋向对等,体现宪法语类对翻译主体的制约;其中强化资源和聚焦资源呈显化趋势,量化资源出现隐化趋势,这与英汉法律语言特征、语类目的关系密切。 Legislative discourse stipulates the economic,political and social systems of a nation and its regions,and constitutional discourse in particular forms the designating basis for other legislative discourse.Previous studies on translation of legislative discourse have mainly focused on their vocabulary and style but few attention has been paid to the translation of attitudinal resources in discourse.Following Appraisal Theory from the perspective of SFL,this paper takes the Constitution of People’s Republic of China and its English versions as research data,and conducts a comparative analysis of their graduation system by using UAM Corpus Tool 3.0,to explore the influence of legal genres on the English translation of discourse.It is found that the English translation of legal discourse basically follows the proportion of graduation system in the original text,which reflects the constraint of genre on translators;resources of intensification and focusshow the tendency of explicitation,while qualification resources show that of implicitation,which is closely related to legal language features of English and Chinese and the goal of legislative genre.
