深圳先行示范区商事纠纷多元解决机制创新研究

Research on the Innovation of the Diversified Settlement Mechanismof Commercial Disputes in Shenzhen Pilot Demonstration Zone

随着深圳先行示范区建设的不断推进,内地商事和跨境商事业务日益频繁,商事纠纷的数量也逐渐攀升,多元有效地解决商事纠纷是打造深圳先行示范区稳定有序营商环境的必经之路。依托我国多元化纠纷解决机制改革的背景,借力《深圳经济特区矛盾纠纷多元化解条例》的实施,深圳前海法院、深圳前海国际商事调解中心、深圳国际仲裁院等专业机构融通联合,形成了内地与港澳法律规则衔接的纵向联通,“诉讼与非诉讼”多元纠纷解决方式的横向融合,构建了一体化、实效化、便民化的商事纠纷多元解决机制,加强深圳先行示范区法治城市建设。

With the continuous promotion of the construction of the Shenzhen Pilot Demonstration Zone,mainland commercial and cross-border commercial businesses have become increasingly frequent,and the number of commercial disputes has gradually increased.Resolving commercial disputes in a diversified and effective manner is the only way to create a stable and orderly business environment in the Shenzhen Pilot Demonstration Zone.Based on the background of the reform of China's diversified dispute resolution mechanism and the implementation of the Regulations on the Diversified Resolution of Conflicts and Disputes in the Shenzhen Special Economic Zone,professional institutions such as the Shenzhen Qianhai Court,the Shenzhen Qianhai International Commercial Mediation Center,and the Shenzhen International Arbitration Court have combined to form a vertical connection between the legal rules of the mainland and Hong Kong and Macao,and a horizontal integration of multiple dispute resolution methods of litigation and non litigation,which has built an integration,effectiveness and diversified settlement mechanism for commercial disputes that is convenient for the people and strengthemed the construction of a law-based city in Shenzhen's leading demonstration area.
