短视频平台著作权侵权责任认定的实证研究

An Empirical Study on the Determination of Copyright Infringement Liability on The Short Video Platform

在我国短视频行业迅猛发展的同时,短视频著作权侵权纠纷问题也日渐突出。其中,如何认定短视频平台侵权责任是司法实践中的焦点问题。通过实证研究发现,司法实践中存在平台事前的审查职责未明确、注意义务的认定标准不合理以及通知与删除的效力不明三个方面的问题。因此,应当明确平台事前的审查职责、调整注意义务的认定标准以及明晰通知与删除的效力。

With the rapid development of China's short video industry,short video copyright infringement disputes are becoming increasingly prominent.The focus in judicial practice goes to the identification in the tort liability on the short video platform.An empirical research leads to the findings that such three problems are found in judicial practices as the unclear responsibility of prior review for platform,the unreasonable recognition criteria in duty of care,and the ambiguous efficacy in notification and deletion.Therefore,it is necessary to clarify the platform's prior review responsibilities,adjust the recognition criteria in duty of care,and explicate the efficacy of notification and deletion.
