网络化、数字化、智能化融合发展推动了社会治理模式的数字化变革与重塑,对传统司法秩序包括结构层的司法架构、实体层的治理规则、应用层的技术嵌入等产生了深刻影响。建设契合数字文明需要的数字司法治理体系成为时代课题。在具体发展路径上,数字法治建设应当遵循融合性的思维导向,在构建数字司法治理逻辑范式基础上,以算法、数据、平台数字生产力三要素为重点,系统推进数字社会治理法治化。

The integrated development of the network,digitization,and intelligent technology has motivated the digital transformation and reshaping of social governance models,which deeply impacts the traditional judicial system,including the judicial framework at the structural level,governance rules at the substantive level,and embedded technologies at the application level.Establishing a digital judicial system that meets the needs of digital civilization has become a major contemporary issue facing the world today.In terms of specific development paths,the construction of a digital rule of law should follow an integrated thinking approach,focus on the three key elements of algorithm,data,and platform's digital productivity,and systematically promote the law-based digital social governance.
